We represented in-house counsel to a petroleum refiner during a criminal enforcement matter. The government had alleged in a multi-count indictment that our client, along with the company and other company employees, had violated the Clean Air Act and made false statements to the government.
In court proceedings in the Fifth Circuit, we demonstrated that the government's allegations against our client were based on erroneous interpretations of the Clean Air Act and unsupported by the facts. The court dismissed almost all of the allegations. Shortly thereafter, the government settled and dismissed all charges against our client.
